Purpose

Advise the Board of County Commissioners and the Health Department director on pertinent issues relating to environmental health legislation and enforcement practices.

Revoke or suspend any and all licenses, certificates and permits issued by the Health Department or the Board pursuant to the Broward County Code of Ordinance for violations.

Order the Health Department to correct any condition or act which is determined to be a violation of the Broward County Code and injurious to the health of the community; assess and levy liens upon the real property on which the violation existed.

Broward County Ordinance #77-67, enacted November 16, 1977, establishing an Environmental Health Board to be known as the Broward County Health and Sanitary Control board; repealing the Food Protection Advisory Board.

Pursuant to Chapters 381, 386, 402, 403, 404, 501, 513, and 514, Florida Statutes, as amended.

Pursuant to Chapter 10, Sections 62-550, 62-551, 62-555, and
62-560, Florida Administrative Code, as amended.

Amended by Ordinance #78-35, enacted August 16, 1978, providing for the president of the Early Childhood Association of Broward County and the president of the Broward County Nursery and Kindergarten Association be added as members.

Amended by Ordinance #82-47, enacted August 19, 1982, providing that the president of the Early Childhood Association of Broward County and the president of the Broward County Nursery and Kindergarten Association be deleted as members; providing for the appointment of alternates to the position of biologist or chemist and veterinarian; providing that the director of Environmental Health of the Broward County Health Department is deleted as an ex-officio member.

Amended by Ordinance #84-73, enacted October 18, 1984, revising administrative procedures regarding violations; repealing and reenacting authorities and powers of the board; changing penalties and fees.

Amended by Ordinance #87-81, enacted December 8, 1987, changing one of the appointed positions on the board from Doctor of Veterinary Medicine to Health Professional.

Amended by Ordinance #91-30, enacted August 13, 1991, providing for revisions relating to the Florida Administrative Code.

Amended by Ordinance #94-37, enacted July 12, 1994, deleting the representation of the president of the Broward County Restaurant Association; adding the representation of the president of the Broward County Chapter of the Florida Engineering Society.

Amended by Ordinance #96-08, enacted April 9, 1996, deleting the representation of the Broward County Medical Examiner; providing revisions to procedures for board hearings.

Amended by Ordinance #2002-22, enacted June 11, 2002, increasing the membership to reflect one appointment by each of the County Commissioners; providing for imposition of administrative costs for successful prosecution of violations of the County code.

Amended by Ordinance #2005-02, enacted January 11, 2005, deleting the category of a person holding a degree in biology or chemistry; adding the category of a person who is licensed in one of the construction trades and an alternate, who need not be in the same discipline; adding that vacancies be filled as they occur, and there are no prescribed terms for the members.

Amended by Ordinance #2009-23, enacted April 28, 2009, deleting the requirement that one member shall be a doctor of medicine or an osteopathic physician and one member shall be a construction trades alternate; adding the requirement that one member shall be a health care professional and one member shall be a person licensed in one of the construction trades; and changing the membership of the appointee of the Broward League of Cities to an elected city official.

Membership

Ten (10) members.

(1) Each Broward County Commissioner shall appoint one (1) member, of which one (1) shall be a health care professional and one (1) shall be a person who is licensed in one of the construction trades.

(2) The Broward League of Cities shall appoint an elected city official.

DUAL OFFICEHOLDING:
The Florida Constitution prohibits a person from simultaneously holding more than one office under the government of the state, counties, and municipalities. The prohibition applies to both elected and appointed offices. It is not necessary that the two offices be within the same governmental unit.


Terms

Section 1-233 of Chapter 1, Article XII, Broward County Code of Ordinances, as may be amended from time to time.

Quorum

Three (3) members of the board constitute a quorum to sit as a hearing panel and a majority vote of the hearing panel shall be final.
