Asbestos Demolition Project

The asbestos program has been instituted through federal regulations enforced by Broward County and the U.S. Environmental Protection Agency (U.S. EPA) to prevent uncontrolled disturbance and/or removal of asbestos containing building products during the renovation or demolition of public, commercial, industrial and certain types of residential structures. The National Emission Standards for Hazardous Air Pollutants (NESHAP), is complemented by Florida State rules, which regulate the licensing aspect of persons or companies engaged in removing asbestos from or demolishing regulated structures. The state also certifies and approves training programs for institutions involved in the training and certification of consultants, contractors, project monitors, project supervisors or workers.

The federal asbestos NESHAP classifies asbestos containing materials (ACM) as follows:

a) Friable - material that when dry, may be crumbled or reduced to powder by hand pressure (includes pipe wrap, air cell, sprayed on or troweled on ACM), or prior category I or category II material that has lost it's structural integrity.

b) Non-friable -

(i) Category I non-friable material - are asbestos-containing resilient materials such as vinyl floor covering [commonly known as vinyl asbestos times (VAT)], asphalt roofing products, packings, gaskets, etc., provided the material is in good condition at the time of the proposed demolition or renovation.

(ii) Category II non-friable material - all other non-friable material provided the material is in good condition at that time of the proposed demolition or renovation.

Person(s) engaged in or proposing to engage in the demolition of a facility shall submit to the Air Quality Division a completed Statement of Responsibilities Regarding Asbestos form.  A triplicate copy of this form must be obtained from the Environmental Protection Department's Air Quality Division at 115 South Andrews Avenue, Room A-240 in Fort Lauderdale, Florida.  Completed forms are submitted to the Air Quality Division.  The yellow copy of the submitted form is required by city and municipality government Building Departments in Broward County before issuance of a demolition/renovation permit.  (You may view a PDF version of the form and instructions by clicking the link above, however the PDF version of this form is NOT acceptable for submittal.)   If any box is marked in Section 1 AND Section 2 of the Statement of Responsibilities Regarding Asbestos form, a  Notice of Asbestos Renovation or Demolition form will also be required.  (The PDF version of this form is acceptable for submittal.)  The Notice of Asbestos Renovation or Demolition form must be submitted to the Air Quality Division at least ten (10) working days in advance of the proposed demolition, regardless of the amount of ACM.  If you require further information, please contact the Environmental Protection Department Air Quality Division at (954) 519-1220.

Person(s) engaging in or proposing to engage in the renovation of a facility involving in excess of 160 square feet or 260 linear feet (e.g. piping insulation) of regulated ACM shall submit to the Air Quality Division a complete Notice of Asbestos Renovation or Demolition form at least ten (10) working days in advance of the proposed renovation. Regulated ACM is any asbestos containing material that is considered friable, or which may reasonably be expected to become friable as a result the removal process.

Broward County conducts inspections of demolition and renovation sites to ensure compliance with federal asbestos NESHAP requirements. Broward County initiates enforcement actions for failure to provide ten (10) working day advance notice of such activities as well as non-compliance with specific asbestos handling work practices.
